RD119: pEPR recyclability assessment obligations for January to June 2025
This Regulatory Decision (RD) is valid until 31 January 2027 by which time it will be reviewed. You should check back at that time to ensure the RD is still valid.
Natural Resources Wales (NRW) can withdraw or amend this RD before the review date if we consider it necessary. This includes where the activities that this RD relates to have not changed.
Regulatory Decision
The Producer Responsibility Obligations (Packaging and Packaging Waste) Regulations 2024 (‘the 2024 Regulations’) places obligations on packaging producers to assess, record and report certain information.
Before relying on this RD please refer to the statement made by the Scheme Administrator, PackUK to understand how reliance on the RD will affect your disposal fee liability for the assessment year 1 April 2026 to 31 March 2027.
Conditions you must comply with
This RD allows producers to take additional time to comply with their recyclability assessment obligations for the reporting period 1 January to 30 June 2025 or rely as an alternative, on the assessment made in the next reporting period.
This RD does not change your legal requirements to:
- Assess the recyclability of household packaging supplied in the reporting period 1 January to 30 June 2025.
- Keep records of the recyclability assessments.
- Report the recyclability assessments to NRW on or before 1 October 2025.
However, NRW will not normally take enforcement action if a producer does not comply with their legal requirements for the reporting period 1 January to 30 June 2025 to:
- assess the household packaging
- keep the records
- report the data
Enforcement
This RD does not change or remove any of your legal obligations under the 2024 Regulations.
However, NRW will not normally take enforcement action if you do not comply with the specific legal requirements set out in this RD.
